Welcome to Booty Center (“Company,” “we,” “us,” or “our”). By accessing our website at https://bootycenter.com/ (the “Site”) and using our coaching services, digital programs, AI tools, or purchasing our products (collectively, the “Services”), you agree to be bound by the following Terms and Conditions (the “Terms”).

If you do not agree to these Terms, please do not use our Site or Services.

1. HEALTH AND FITNESS DISCLAIMER

  • Nature of Services: Booty Center provides fitness and nutrition coaching. We are not medical professionals. The information provided is for educational and self-improvement purposes only.
  • Consult Your Doctor: You should consult with a physician or other healthcare professional before starting any exercise or nutrition program to determine if it is right for your needs. This is particularly important if you have a history of high blood pressure, heart disease, or any physical disability.
  • Assumption of Risk: By using our Services, you acknowledge that physical exercise involves inherent risks of injury. You voluntarily assume all risks associated with such activities. Booty Center is not responsible for any health problems or injuries you may experience as a result of training programs, products, or advice found on the Site.

2. ELIGIBILITY

By using this Site, you represent that you are at least 18 years of age. If you are under 18, you may only use the Site with the involvement and express consent of a parent or legal guardian.

3. ACCOUNTS AND REGISTRATION

To access certain features (such as the Coach Panel or personalized programs), you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Notify us immediately at [email protected] if you discover any security breaches related to your account.

4. PAYMENTS AND SUBSCRIPTIONS

  • Pricing: Prices for coaching (e.g., The Kickstarter 6-Week or The Success Path 12-Week) and apparel are displayed on the Site. We reserve the right to change pricing at any time.
  • Billing: Payments are processed through secure third-party gateways. By providing payment information, you authorize us to charge the applicable fees to your designated payment method.

5. REFUND POLICY

  • Digital Programs & Coaching: Due to the personalized nature of our coaching and the immediate delivery of digital intellectual property (custom plans, AI access, and proprietary methodology), all coaching sales are final. No refunds will be issued once the initial assessment has begun or program materials have been delivered.
  • Apparel: Physical products (leggings, tops, etc.) may be returned within 14 days of receipt, provided they are unworn, unwashed, and in original packaging with tags attached. Return shipping costs are the responsibility of the customer.

6. AI TOOLS AND PRIVACY

Our Site offers AI-powered tools including a Body Scanner, Meal Tracker, and Lab Results Parser.

  • Data Usage: By using the Body Scanner, you consent to the processing of your images for physical analysis. While we prioritize privacy and state that images are deleted after analysis, you acknowledge that no transmission over the internet is 100% secure.
  • No Medical Diagnostics: AI-generated insights (including lab results parsing) are estimates and should never replace professional medical diagnostics or bloodwork interpretation by a licensed physician.

7. INTELLECTUAL PROPERTY

All content on this Site including text, graphics, logos, workout plans, videos, and software is the property of Booty Center or its content suppliers and is protected by U.S. and international copyright laws. You are granted a limited, non-transferable license to access the content for personal, non-commercial use only. Redistribution or resale of our custom plans is strictly prohibited.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Booty Center, its directors, employees, or agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site or Services. Our total liability for any claim arising out of these terms shall not exceed the amount paid by you to the Company in the 12 months prior to the claim.

9. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding related to your access to, or use of, the Site or Services shall be instituted in a state or federal court in Orange County, California.
